1. Agreement and scope
These Terms of Use ("Terms") are an agreement between you and New Territory Media ("VP Land," "we," "us," or "our"), the California operator of VP Land. They govern your access to and use of vp-land.com, VP Land accounts, newsletters, public submission forms, content, and related services that link to these Terms (collectively, the "Services").
By using the Services, creating an account, subscribing, purchasing a paid subscription, or submitting material, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Services.
Third-party services used with the Services may have their own applicable terms and policies.
2. Eligibility
You must be at least 13 years old to use the Services. If you are under the age of legal majority where you live, a parent or legal guardian must authorize your use and any purchase. You may not use the Services if doing so would violate applicable law.
3. Accounts
You are responsible for providing accurate account information, maintaining the confidentiality of your credentials, and all activity under your account. Tell us promptly if you believe an account has been compromised. We may limit, suspend, or close an account that violates these Terms, threatens the Services, or is used fraudulently or unlawfully.
4. Newsletters and paid subscriptions
When you subscribe to a VP Land newsletter, you authorize us and Beehiiv to send it to the email address you provide. You can unsubscribe from marketing emails at any time using the link in an email. We may still send necessary account, security, billing, or legal notices.
We use Beehiiv and Stripe in connection with newsletter and paid-subscription services. Review the Beehiiv Privacy Policy, Beehiiv Terms of Use, and Stripe Privacy Policy for more information about their services and data practices.
The price, billing interval, renewal terms, taxes, trial terms, and other purchase details displayed at checkout or on the subscription-management page are part of your purchase agreement. If a subscription is recurring, you authorize the displayed recurring charges until you cancel. You can review or cancel a subscription through the subscription management page. Cancellation and refund terms shown at checkout or in your account apply, subject to rights that cannot be waived under applicable law.
5. VP Land content and intellectual property
The Services and their articles, newsletters, videos, podcasts, databases, graphics, branding, design, software, and other materials are owned by New Territory Media or its licensors and are protected by intellectual-property laws. You may access and share links to VP Land content for personal, noncommercial use.
Unless we give written permission or applicable law allows it, you may not reproduce, republish, sell, syndicate, modify, create derivative works from, systematically download, scrape, train a model on, or commercially exploit VP Land content or datasets. Brief quoting with clear attribution and a link to the original is permitted where allowed by law.
6. Material you submit
You retain ownership of material you submit. You grant New Territory Media a non-exclusive, worldwide, royalty-free license to store, review, reproduce, edit, adapt, publish, display, distribute, and promote that material as reasonably needed to evaluate the submission and, if accepted, include it in VP Land and related editorial or promotional materials.
By submitting material, you represent that:
- the information is accurate to the best of your knowledge;
- you have the rights and permissions needed to provide it and grant this license;
- it does not violate law, privacy, confidentiality, or another person's rights; and
- it is not deceptive, malicious, defamatory, or designed to distribute spam or malware.
We are not required to publish a submission and may verify, edit, reject, unpublish, or remove it at any time. Do not submit confidential information or sensitive personal information.
7. Acceptable use
You may not:
- use the Services for unlawful, fraudulent, abusive, or harmful activity;
- interfere with security, access controls, rate limits, or normal site operation;
- probe, scan, reverse engineer, or attempt unauthorized access to systems or accounts;
- use automated means to harvest personal information or overwhelm the Services;
- impersonate another person or misrepresent an affiliation; or
- upload malware or content that infringes or violates another person's rights.
8. Editorial information and listings
VP Land provides news, commentary, directories, event listings, job listings, tool information, and other editorial material for general informational purposes. It is not legal, financial, investment, employment, safety, or other professional advice. References to a company, product, event, job, or service do not necessarily constitute endorsement.
We work to keep information useful and accurate, but technology, prices, availability, claims, links, deadlines, and job or event details can change. Verify important information with the relevant provider before relying on it or making a purchase, application, or other decision.
9. Third-party services and links
The Services link to and may embed websites, videos, platforms, tools, employers, events, payment services, and other resources we do not control. Your use of a third-party service is governed by that provider's terms and policies. We are not responsible for third-party content, availability, security, products, transactions, or practices.
10. Service changes and termination
We may add, change, suspend, or discontinue parts of the Services and may remove content or restrict access when reasonably necessary. You may stop using the Services at any time and may manage a paid subscription using the link above. Provisions that by their nature should survive termination—including ownership, licenses already granted, disclaimers, and limits on liability—will survive.
11. Disclaimers
To the fullest extent permitted by law, the Services are provided "as is" and "as available." New Territory Media disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not promise that the Services will always be available, secure, accurate, complete, or error-free. Nothing in these Terms excludes a warranty or consumer right that cannot legally be excluded.
12. Limitation of liability
To the fullest extent permitted by law, New Territory Media and its owners, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or opportunities arising from or related to the Services. This limitation does not apply where liability cannot be limited under applicable law.
13. Changes to these Terms
We may update these Terms as the Services or law changes. We will post the revised Terms here and update the effective date. If a change is material, we may provide additional notice. Your continued use after updated Terms take effect means you accept them, except where law requires another form of consent.
14. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, except to the extent the law where you live gives you non-waivable rights. Any dispute that may be brought in court will be brought in a court with appropriate jurisdiction in California, unless applicable law requires otherwise.
